Terms of Service

Acceptance of Terms

By downloading, installing, or using Pawdio, you agree to these Terms of Service. If you do not agree, do not use the software. These Terms should be read in conjunction with our Privacy Policy, which governs our collection and use of your information.

Eligibility & Minimum Age

You must be at least 13 years old to use Pawdio. In European Union member states where the minimum age for processing personal data is higher (up to 16 years old, depending on your country of residence), you must meet that higher age requirement. By using Pawdio, you represent that you meet the applicable minimum age requirement in your jurisdiction.

License Grant

Pawdio grants you a non-exclusive, non-transferable, revocable license to use the software on your personal Mac computer, subject to these Terms. The available tiers and their word limits are:

  • Free — 500 words per day, no account required.
  • Standard — 1,000 words per day with 7-day rollover ($5/month, or $4/month billed annually).
  • Unlimited — Unlimited words ($15/month, or $12/month billed annually).
  • Lifetime — Unlimited words, one-time purchase of $150.

Intellectual Property

All rights, title, and interest in and to the Pawdio software — including its code, design, trademarks, logos, and documentation — are and remain the exclusive property of Drew Howlett, operating as Pawdio. Nothing in these Terms grants you any ownership interest in the software. Your license to use Pawdio is limited to the rights expressly granted in these Terms.

User Content Ownership

You retain full ownership of all text generated through your use of Pawdio, including all transcriptions and dictated content. Pawdio claims no rights, license, or interest in your transcribed text. Because all transcription is processed locally on your device, we never have access to your content.

Subscriptions & Payments

Paid plans are billed through Stripe. Monthly and annual subscriptions renew automatically at the then-current price until you cancel. You will be charged at the start of each billing period. You may cancel at any time through the Stripe customer portal — cancellation takes effect at the end of the current billing period. No partial refunds are given for unused time within a billing period. Refunds for other circumstances are handled on a case-by-case basis.

To cancel: Open Pawdio → Settings → Manage Subscription, or visit the Stripe customer portal link in your purchase confirmation email.

Lifetime licenses are a one-time purchase granting unlimited usage indefinitely. Lifetime licenses are non-refundable after 30 days.

Automatic Renewal Disclosure (California SB-313)

If you are a California resident, the following disclosures apply. By subscribing to a paid plan, you acknowledge and agree that:

  • Your subscription will automatically renew at the end of each billing period (monthly or annually) at the then-current price unless you cancel before the renewal date.
  • Standard plan: $5/month (monthly) or $48/year ($4/month, billed annually). Unlimited plan: $15/month (monthly) or $144/year ($12/month, billed annually).
  • You may cancel at any time by opening Pawdio → Settings → Manage Subscription, or by visiting the Stripe customer portal link in your purchase confirmation email.
  • Cancellation takes effect at the end of the current billing period. You will not be charged for subsequent periods after cancellation.

EU Right of Withdrawal

If you are located in the European Economic Area (EEA) or the United Kingdom, you have the right to withdraw from a purchase within 14 days of the transaction date without giving any reason (the “cooling-off period”).

However, because Pawdio is a digital product that is delivered immediately upon purchase, you acknowledge and expressly consent that performance of the service begins immediately after your purchase is confirmed. By completing your purchase, you waive your 14-day right of withdrawal to the extent permitted by Directive 2011/83/EU, Article 16(m). If you do not consent to immediate delivery and wish to preserve your right of withdrawal, please contact us at legal@drewhowlett.com before completing your purchase.

Word Budget

The Free tier includes 500 words per day. The Standard tier includes 1,000 words per day. For these tiers, unused words roll over for up to 7 days. The Unlimited and Lifetime tiers have no word limit. Word counts are tracked locally on your device. We do not monitor your usage remotely.

Acceptable Use

You may not reverse-engineer, decompile, or modify the software. You may not share, redistribute, or resell license keys. You may not use Pawdio to process content that violates applicable laws.

Disclaimer of Warranties

Pawdio is provided “as is” without warranty of any kind. Transcription accuracy depends on audio quality, accent, and other factors. We do not guarantee perfect transcription results.

Limitation of Liability

To the maximum extent permitted by law, Pawdio and its creators shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the software, including but not limited to loss of data, loss of profits, or business interruption.

In no event shall the total aggregate liability of Pawdio and its creators for all claims arising out of or related to these Terms or your use of the software exceed the greater of: (a) the total amount you have paid to Pawdio in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) fifty US dollars ($50). For Lifetime license holders, the cap shall be the price paid for the Lifetime license.

Governing Law & Jurisdiction

These Terms are governed by the laws of the State of Illinois, United States, without regard to conflict of law provisions. Any disputes arising from these Terms or your use of Pawdio shall be resolved in the state or federal courts located in Cook County, Illinois.

Dispute Resolution

Before filing any legal claim, you agree to first contact us at the email below and attempt to resolve the dispute informally for at least 30 days. If the dispute cannot be resolved informally, either party may pursue resolution in the courts specified above.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Force Majeure

Neither party shall be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond the reasonable control of that party, including but not limited to: natural disasters, acts of government, war, terrorism, pandemic, power outages, internet or telecommunications failures, or third-party service disruptions (including Stripe or Hugging Face outages).

Export Control & Sanctions Compliance

Pawdio may be subject to US export control and sanctions laws. You agree not to export, re-export, or otherwise transfer the software to any country, entity, or person prohibited by United States export control laws, including the Export Administration Regulations (EAR) and sanctions programs administered by the Office of Foreign Assets Control (OFAC). You represent and warrant that you are not located in, under the control of, or a national or resident of any country or territory subject to US embargo, and that you are not on any US government restricted party list.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pawdio regarding the use of the software.

Changes to Terms

We may update these terms from time to time. Continued use of Pawdio after changes constitutes acceptance of the new terms. Material changes will be communicated through the application or website.
